Michigan Firm Sues Home Depot Over Fake Garage Door Windows
GRAND RAPIDS, MI – Lacks Home Products LLC is suing Home Depot USA Inc., claiming the hardware chain is selling an inferior version of the fake garage door window produced by its Coach House Accents division.
Lacks, a division of Lacks Enterprises, claims its product is patented and the accent item Home Depot is selling becomes yellow and brittle in the sun, according to a lawsuit filed in federal court.
The cheaper product from Home Depot’s supplier, HD Supply, violates a previous settlement in a patent infringement lawsuit, according to Lacks’ lawsuit, which alleges unfair competition. Lacks is seeking unspecified monetary damages and a permanent injunction barring Home Depot from selling the knock-off.
A spokesman for Home Depot said they will fight the lawsuit.
“We disagree with the claims and we’ll continue to defend our position on that front,” said Stephen Holmes, director of corporate communications for Home Depot.
The dispute goes back to 2011, when a former subsidiary of Home Depot knocked off the product, according to a press release by Lacks.
“Soon after Lacks launched its proprietary garage door accents, Home Depot’s HD Supply subsidiary worked with a Chinese manufacturer to make a nearly identical product, but with alleged inferior materials and quality,” Lacks said in a press release issued Friday, April 22.
